ARTICLE 1 : DEFINITIONS

Unless otherwise stated, the following terms and expressions shall have the meanings set out below:

CNIL :  Refers to the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés).

Data: Refers to any computer data, whether personal or not, collected from the Client during the use of the Software.

Personal Data: Any information relating to an identified or identifiable natural person..

Data Subject: Refers to the natural person whose Personal Data is collected, including the Client or the User.

Regulation: Refers to French Law No. 78-17 of January 6, 1978 on data processing, files and freedoms as amended, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (the “GDPR”), and any applicable legislation on the protection of Personal Data.

Data Controller: Refers to the person who determines the purposes and means of the Processing.

Processing: Refers to any operation or set of operations performed on Data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure, alignment or combination, restriction, erasure, or destruction.

User: Any person authorized by the Client to use the Software.

Personal Data Breach: Refers to a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Data transmitted, stored, or otherwise processed.

These definitions are capitalized and apply in both singular and plural forms.

ARTICLE 2: PURPOSE

The purpose of this Privacy Policy is to inform the Client of STRADA’s policies and practices regarding the collection, use, and disclosure of information concerning the Client and/or the User, obtained via STRADA’s website or during the conclusion or performance of the contractual relationship between STRADA and the Client.

ARTICLE 3: SCOPE

Use of the website www.services.strada.eu, and where applicable, the acquisition of Software and/or Onboard Equipment and/or related Services (hereinafter “Products and Services”), implies the Client’s acceptance of this Privacy Policy. STRADA reserves the right to amend this Privacy Policy at any time and will notify the Client of such changes by any appropriate means. Continued use of the Software and/or Onboard Equipment and/or Services after the effective date of the changes shall constitute the Client’s unreserved acceptance of the updated Privacy Policy.

ARTICLE 4: PERSONAL DATA – LEGAL BASIS

In the context of performing the Contract, STRADA, acting as Data Controller, collects only the Personal Data of the Client and/or User that is necessary or useful for the performance of the commercial relationship, STRADA’s business activities, or its legitimate interests. Unless otherwise specified, the provision of such Personal Data is mandatory and may be a condition for entering into the Contract or may affect the nature of the contractual relationship.

ARTICLE 5: PURPOSES

Managing client relationships and commercial interactions, Conducting marketing and promotional activities to present STRADA’s products and services, Creating commercial statistics, Using cookies to enhance the Client’s browsing experience, Performing marketing analysis, Organizing promotional campaigns, Managing requests for access, rectification, and objection rights, Handling unpaid invoices and disputes, Complying with legal and regulatory obligations, including fraud prevention

ARTICLE 6: RECIPIENTS

STRADA employees, service partners, subcontractors, and commercial providers contractually bound to perform tasks related to the purposes described above; organizations conducting surveys or studies; and public bodies, administrative or judicial authorities, to comply with legal and regulatory obligations applicable to STRADA.

ARTICLE 7: MARKETING / COMMERCIAL SOLICITATION

The Client may, at any time and free of charge, object to the use of their Personal Data for marketing purposes without providing justification, by sending a letter to STRADA at:10 Rue Jean Mermoz, 79300 Bressuire, France.The Client may also register on the “Bloctel” telephone solicitation opt-out list at: https://conso.bloctel.fr/.STRADA notes that exercising the right to object does not prevent STRADA from contacting the Client for other purposes, such as legal obligations or the performance of the commercial relationship.

ARTICLE 8 : TRANSFERS

The Client is informed and hereby authorizes STRADA to transfer their Personal Data, for the performance of the Contract, to countries outside the European Union that have been deemed adequate by the European Commission, to U.S. companies self-certified under the Privacy Shield framework and listed in the relevant U.S. registry, and to non-EU countries not recognized as adequate by the European Commission, provided that appropriate safeguards are in place in accordance with the Regulation and that enforceable rights and effective legal remedies are available to Clients.

ARTICLE 9 : DATA RETENTION

With respect to client relationship management, STRADA retains all Personal Data until the end of the commercial relationship, subject to any legal or regulatory provisions requiring specific retention periods for certain categories of Personal Data. After the end of the commercial relationship, such Personal Data is archived in anonymized form for statistical purposes, for no longer than necessary for the purposes for which it is retained.

ARTICLE 10 : CLIENT RIGHTS

In accordance with the Regulation, the Client and, where applicable, the User, have the right to access, rectify, and object to the Processing of their Personal Data on legitimate grounds. As of May 25, 2018, under the GDPR, the Client also has the right to restrict Processing, the right to erasure, and the right to data portability. These rights may be exercised by sending a dated and signed letter to STRADA at the following address:10 Rue Jean Mermoz, 79300 Bressuire, France,accompanied by a copy of a valid identity document.

The Client and the User may also bring a claim before the competent courts, without prejudice to their right to lodge a complaint with the CNIL, if they believe that their rights under the applicable Regulation have been violated.

3 | Lisibility

STRADA disclaims all liability for any difficulties encountered when accessing the Website or for any communication failures. STRADA shall not be held liable for any damage or virus that may infect the user’s computer or any other IT equipment as a result of using or accessing the Website or downloading content from it.
